Our wish list for the Whistleblower Protection Act
We at the Integrity Coordinator are quite enthusiastic about the EU directive to protect whistle-blowers. In recent years, many shady cases and serious misconduct have been brought to light by whistleblowers, after which measures could be taken to prevent worse. And to prevent it from happening again. It is therefore important that whistleblowers feel free to express their concerns without fear of retaliation. However, we also have five suggestions to improve the law.
Will the Netherlands meet the 17 December deadline?
That remains to be seen. The European Whistleblower Protection Directive states that all Member States have to implement the Directive into their national law by December 17 2021. Most organisations will have to comply with the new law at this date.
New government website “Law on the Protection of Whistleblowers”
The Ministry of the Interior launched a website to inform the general public about the upcoming changes. On June 11th, shortly after the launch, we informed the Ministry that the information was incomplete. We expect that this concerns thousands of companies.
New: The Dutch Whistleblower Protection Act
The new Dutch Whistleblower Protection Act strengthens the position of whistleblowers. According to the new law, organizations must appoint an independent Integrity Coordinator. For international organizations, it will become more difficult to roll out one speak-up procedure for the entire organization. However, The Integrity Coordinator suggests a solution for this.
