Introduction Whistleblower Protection Act

On 18 February 2023, the Whistleblowers Protection Act came into force. Therefore, many organisations must establish or adapt their whistleblowing procedure.

As of now, legal entities with 250 employees or more must have adapted their whistleblowing procedure and have designated one or more independent persons to receive and/or follow up whistleblower reports.

This also applies to all parties in the financial sector and all organisations required to comply with anti-money laundering legislation, regardless of their size. Legal entities with 50-249 employees still have until 17 December 2023 to prepare for this.

So note that all such legal entities will need to set up their own, local whistleblowing procedures. A multinational company with an international network of different entities in the various EU countries will have to set up its own whistleblowing procedure for each entity. The same applies to a chain with several branches in the Netherlands.

Under the new Whistleblower Protection Act, organisations must appoint an independent person or department to receive whistleblower reports and someone to follow up on the reports. These two roles can be combined! We call this the position of integrity coordinator.

It is often quite a challenge to find someone within the organisation who can fulfil this role well and who is also completely independent. After all, it is difficult to be independent and objective when reports come in about colleagues. Therefore, appoint us as an experienced, external integrity coordinator.
