It is a proposal to encourage the reporting of wrongdoing and to improve the protection of whistleblowers. In the Memorandum, Omtzigt stresses the immense importance of whistleblowers for the rule of law, as without them many cases of corruption, fraud, human rights violations and other abuses would never have come to light. He believes that the current bill unfortunately offers too little protection for whistleblowers. Therefore, he has submitted fifteen proposals for improvement. The most important ones are as follows:<\/p>\n<ol>\n<li>According to the current legislation, whistleblowers are protected if they report wrongdoing that affects the public interest. Omtzigt proposes to delete the criterion of \u2018public interest\u2019. We fully agree with this. In other EU countries we also see that whistleblowers, who report breaches of national legislation and serious misconduct, are protected. The exact wordings will likely be the subject of further debate.<\/li>\n<li>Reporters may not be disadvantaged if they have made a report. The burden of proof for this is reversed and will fall on the employer: he must demonstrate that there was no retaliation against the whistleblower. Omtzigt would like to add that the reversal of the burden of proof must also apply to proving the wrongdoing, for example in the case someone claims to have become ill because of unsafe working conditions, and to the investigations of the House for Whistleblowers on how whistleblowers have been treated.<\/li>\n<li>In addition, it must become possible to report anonymously. It is important to receive as many reports as possible, even though anonymous reports are sometimes more difficult to investigate. The Minister indicated in April that she foresees technical problems in this respect. This position is incomprehensible to us; safe technical solutions have existed for years and have also been used by foreign governments for years.<\/li>\n<li>Omtzigt is in favour of the House for Whistleblowers operating independently of the Ministry of the Interior. This external reporting channel must operate independently of the government. This is even more important if the report concerns the actions of the government.<\/li>\n<li>There must be sanctions to deter employers who retaliate against whistleblowers or who, contrary to the law, have no or an incorrect internal reporting procedure. The imposition of a sanction must be made public. Criminal prosecution of directors who retaliate against whistleblowers and\/or personal liability for persons who retaliate against whistleblowers could also be considered.<\/li>\n<li>Ensure supervision of the internal and external reporting channels. For example, by the Labour Inspectorate. At the moment, this is completely lacking. And since the House for Whistleblowers has not always functioned well in practice, there must also be some form of supervision of the House.<\/li>\n<li>Furthermore, a fund must be set up for psychosocial support and legal assistance for whistleblowers, among other things. This fund could for example be fed by fines imposed on organisations that do not comply with the Whistleblower Protection Act.<\/li>\n<li>Currently, an exception is made for the reporting of secret information from national intelligence and security services. Omtzigt suggests setting up a separate reporting channel for reporting state-secret information.<\/li>\n<li>It is suggested to prohibit the tapping or interception of whistleblower reports. Practice has shown that this does occur. It is all the more remarkable that the current Dutch bill does not mention anything about the security of reporting channels, while this is required by the European Directive. Prohibit harming family members of whistleblowers outside the work environment, as well as persons who are wrongly perceived as whistleblowers and organisations that support whistleblowers.<\/li>\n<\/ol>\n<p>The Integrity Coordinator endorses all 15 proposals of Omtzigt&#8217;s memordandum. It is a well-founded document that is worth reading. Unfortunately, we are still missing a couple of points that we have included in our <a href=\"https:\/\/www.deintegriteitscoordinator.nl\/en\/our-wish-list-for-the-whistleblower-protection-act\/\">wish list for the Whistleblower Protection Act<\/a>, namely a right to have privileged conversations for integrity coordinators and a coordinating role for the House for Whistleblowers in external reporting.<\/p>\n<p>The Memorandum was well received by the other political parties and by the Minister. The Minister indicated that she would like to send her response to the memoraundum and the next amendment to the current draft law at the same time. We will return to this in the next newsletter.<\/p>\n<p>Together with Femke Heijmans, who also collaborated on the memorandum, Pieter Omtzigt published another interesting <a href=\"https:\/\/www.nrc.nl\/nieuws\/2022\/04\/15\/stop-het-pesten-van-klokkenluiders-a4113846\">article in the NRC newspaper<\/a> (Dutch language).
