On Sept. 13, there was a debate in the House of Representatives on the Whistleblower Protection Act. Secretary of State Van Huffelen promised to speed up progress. Then in October, three motions from House members were passed.<\/p>\n

On Sept. 13, the House of Representatives Interior Committee hosted a debate on whistleblowers. After the fall of the cabinet and the departure of Minister Hoekstra to the European Commission, State Secretary Van Huffelen became the responsible minister. Present were representatives of the VVD, D66, CDA and SP.<\/p>\n

The secretary of state indicated that it was a subject close to her heart and that she had dealt with the subject and its importance in past work circles. She wants to keep up the pace. A new bill will go into consultation early next year. We can then expect the new proposal in mid-2024. This includes a focus on the sanctions that can be imposed by the House of Whistleblowers. A preliminary legal review is currently being conducted by the firm Pro Facto. A fund for whistleblowers will also be established. An opinion on this will follow from ABDTOPConsult. Possibly businesses could make a voluntary contribution to the fund; that is being discussed. Even now, however, whistleblowers can be referred by the House of Whistleblowers to victim assistance for psycho-social support and to the Legal Aid Board for legal support. In the 2024 budget, funds will be set aside for support.<\/p>\n

We at The Integrity Coordinator found it striking that there was talk of psycho-social and legal support, but not further financial support for whistleblowers. Neither did the Minister’s letter<\/a> to the Senate, despite being on the agenda, nor the further rules that are going to require employers to set up anonymous reporting channels. Thus, it was previously indicated that there would be an Internet consultation on this topic after the summer. We haven’t seen those come along yet.<\/p>\n

In the end, the SP group requested a two-minute debate, where three motions were made. The debate took place on Sept. 27 and the vote a week later.<\/p>\n

D66 tabled a motion requesting the government to explore ways in which young athletes and dancers, who are in youth selections but not yet paid, could be covered by the Whistleblower Protection Act or another provision that would provide them with more appropriate protection and whether it would be possible to include the evaluation of the independent integrity center in the evaluation of the Whistleblower Protection Act. Since they are not currently in a work-related context relative to a coach, association or sports league, they are not covered by the Whistleblower Protection Act if they want to make a report about harassment or a culture of fear, for example. This motion passed.<\/p>\n

SP and CDA tabled a motion asking the government to come up with a plan on how the whistleblowers’ fund can eventually become independent of the Ministry of Interior, since it is now on that ministry’s budget. They also submitted a motion asking the government to come up with a proposal so that the proceeds from the sanctions that the House of Whistleblowers will impose will benefit this fund. Both of these motions also passed.<\/p>\n
